Hutton, a tenant of Sir Francis St John baronet, accuses the defendants of, "in a hostile, riotous and tumultuos manner", entering his close called Hadleigh Ray, part of the Manor of Hadleigh in the parishes of Hadleigh Leigh and Benfleet, and using nets to remove a great quantity of oysters and so destroyed the oyster beds there. The land in question was purchased by Sir Francis St John from the Earl of Warwick's family 50 years previously and has been tenanted by Hutton for the past 30 years.
