Recites: i) A marriage is intended between 1) and 2). ii) 1) is entitled to the sum of £7,000 secured to him by promissory note of Francis Edward Stewart of St Kilda Australia Bank manager. iii) Marriage settlement of 2 October 1824, of 2)’s parents, William Kaye, now deceased, and Mary Cecilia Kaye, formerly Mary Cecilia Gibson Craig (see 2651/T1). Under this, 2), as one of the 8 children of William and Mary Cecilia Kaye, is entitled, expectant on the death of her mother, to one 1/8th share of certain trust moneys or the investments representing the same. Now, 1) assigns to 3) the sum of £7,000 and 2) assigns to 3) her 1/8th share in the trust moneys or investments, and after the marriage 3) will stand possessed of these upon trust, when necessary, to invest any money, and to pay the annual income from the £7,000 to 1) during his life, then to 2) for her life, and to pay the annual income from 2)’s 1/8th share to 2) for her life, then to 1) for his life, and after the death of the survivor of 1) and 2), to hold all the investments and the annual income in trust for the children of the marriage, and in default of issue to hold the £7,000 and income, after the death of 2), in trust for 1), his executors, administrators and assigns, and the 1/8th share and income, after the death of 1), in trust for 2) and her heirs. It is also agreed that if 2) or 1) in her right shall become entitled to any real or personal property of the value of £300 or more, they will convey it to 3) upon trust to convert it into money, invest the money and hold it upon the same trusts as 2)’s 1/8th share. |
