Description | 1) William Kaye of Tetworth Hall, Huntingdonshire, esquire. 2) Joseph Kaye of the Middle Temple, barrister at law. 3) Charlotte Alice Prescott of Priors Marston, Warwickshire, spinster, a minor. 4) James Kaye of the Middle Temple, barrister at law, and Henry Prescott of Priors Marston, esquire, trustees. Recites: i) A marriage is intended between 2) and 3). ii) 1) is now bound to 4) in the sum of £4,000 to guarantee the payment to them of £2,000 after the death of the longest live of 1) and Mary Cecilia, his wife. Now, 1) covenants with 2) and 3) that, during the lives of 1) and his wife and the life of the survivor of them (but not further), 1) will cause to be paid to 2) and, if he dies, to 3) one annuity of £200. It is agreed by all the parties that after the marriage 4) shall stand possessed of 1)’s bond and the money thereby secured upon trust to receive the money when it becomes due, to invest the principal sum in their own names and to pay the interest to arise from the bond or the principal money secured thereby or the stocks, etc in which the principal sum may be invested to 2) during his life, then to 3) for her life, and after the death of the survivor of them, to hold the investment and interest in trust for the children of the marriage, and in default of issue, in trust for 2), his heirs and assigns. 2) covenants with 4) that, if 3), or 2) in her right, shall become possessed of any real or personal property of the value of £500 or more, then 2) and 3) will assure the same to 4) upon trust to convert it all to money, to invest the money and to stand possessed of the investment and interest upon the same trusts as above, except that, in default of issue, they will hold in trust for the heirs of 3). |
