Description1) Reverend George Tyndall, rector of Lapworth, Warwickshire, clerk. 2) Jane Powell Kaye of Tunbridge Wells, Kent, spinster. 3) William Kaye of the Middle Temple, London, esquire. Onesiphorus Tyndall Bruce of Falkland, Fifeshire, esquire. Robert Whitmore of Lincolns Inn, Middlesex, gentleman. Marcus McCausland of Fruit Hill, Londonderry, Ireland, esquire. Trustees. Recites: i) A marriage is intended between 1) and 2). ii) 2) is now possessed of the sum of £4,000 East India Stock and of the sum of £2,000 East and West India Dock Stock. iii) 1) has effected in the names of 3) on his own life an assurance with the Law Life Assurance Company for the sum of £3,000. Now, it is agreed by all parties that, after the marriage, 1) will receive the dividends from 2)’s stocks, and as soon as possible after the marriage, so much of the stocks will be sold as will be necessary to raise the sum of £1,000 for 1). The remainder of the stocks will be transferred into the names of 3) and they will hold the same upon trust to pay the dividends to 1) during his life, then to 2), for life, and after the death of the survivor of them, to hold the stocks and dividends in trust for the children of the marriage, and in default of issue, in trust for the heirs of 2). It is also agreed that 3) will be possessed of the policy of Assurance and of all the money which will become payable in respect thereof for 1) and his heirs until the marriage. After the marriage, 3) will invest any money which becomes payable on the policy in their own names and will pay the dividends to 2) during her life, and on her death, will hold the same in trust for the children of the marriage, and in default of issue, in trust for the heirs of 1). Endorsed: Memorandum, 30 June 1848. Recites: i) Marriage of 1) and 2) on 31 December 1844, and the transfer of most of the stocks to 3) on 15 January 1845: a certain part of the stock was sold and £1,000 was paid to 1). ii) The death of 1) on 23 February 1848. There was no issue of the marriage. iii) On 13 April 1848, 3) transferred the stock into 2)’s name. iv) On 23 June 1848, 3) received the sum of £3,136 from the policy of Assurance and paid this into the Bank of England on account of William Kaye for the use of 2). Now, 2) acknowledges the various transfers and payments and indemnifies 3) from the trusts. Attached: 4 receipts for transfers of stock 1845 and 1848.
