Description1) William Kaye of the Middle Temple, London, esquire, barrister at law. 2) James Gibson Craig of Riccarton in the County of Edinburgh, esquire. 3) Mary Cecilia Gibson Craig, eldest daughter of 2). 4) George Tyndall, fellow of Merton College, Oxford, esquire, barrister at law. William Gibson Craig the younger of Riccarton, esquire, advocate. James Thomson Gibson Craig of Edinburgh, writer to the signet. Trustees. Recites: i) A marriage is intended between 1) and 3). ii) Agreement has been reached that 2), after the marriage, should pay to 1) the sum of £1,000 as part of 3)’s marriage portion and should secure to 4) the payment of the annual sum of £ 100 during his lifetime and of the principal sum of £2,000 after his death. It was also agreed that 1) should secure to 4) the investment of a sum of money sufficient to produce the nett annual sum of £200 in the event of 3) surviving him. iii) 1) is now bound to 4) in £8,000 and 2) is now bound to 4) in £4,000 to fulfil the financial arrangements involving 4) as trustees. Now, 2) agrees with 1) that, after the marriage, he will pay to 1) the sum of £1,000. It is agreed by all parties that 4) will invest the sum of £2,000 in their own names and pay the interest from this to 1) during his life, then to 3), for her life, and after the death of the survivor of them, to hold the investment and interest in trust for the children of the marriage, and in default of issue of the marriage and instructions as to the money from 3), in trust for 2). It is agreed that 4) will apply the annuity of £100 in the same manner as the interest of the above sum of £2,000. It is agreed that 4) will receive the money for the £200 annuity, will invest the same in their own names and will stand possessed of the investments and the interest upon the same trusts as those concerning the sum of £2,000, except that, in default of issue of the marriage, they will hold in trust for 1), subject to the life interest therein of 3).
