TitleLands in Buckworth: Absolute Order of the Inclosure Commissioners
DescriptionRecites: 1) Robert Duncombe Shafto of Whitworth Park in the parish of Whitworth, County Durham, Esq, as tenant for his own life is an owner of a limited interest within the meaning of "Landowners' West of England and South Wales Land Drainage and Inclosure Company's Act 1848" in 1,538a 1r 15p of land in the parish of Buckworth, Huntingdonshire (in the occupation of William Sisman, John Horseford, Richard Buckle, John Robert Walker, Mrs Reed and John Edwards) and in 1,069a 0r 13p of land in parish of Morborne, Huntingdonshire (in the occupation of John Laxton, John Earl and Thomas Simpson) referred to in a contract (15 November 1852) made in pursuance of the Act between Shafto and the Company f or the execution by the Company of certain works of drainage and improvement upon the above lands. Recites: 2) Original Order of the Inclosure Commissioners, 20 January 1853, directing that the works in the above contract should be carried out forthwith by the Company and charging the inheritance of the above lands with the sum of £11,604 3s 1d, the sum mentioned in the contract as the sum to be paid for the execution of the works and attendant expenses. Recites: 3) The Commissioners have been satisfied by the Report of Henry Bertram Gunning, a surveyor appointed by them, that the works directed have been done on 8 fields (156a 3r 2p) in the parish of Buckworth and that £z691 4s 5d has been properly expended in the execution thereof. Recites: 4) It is the opinion of the Commissioners that the inheritance of the 156a 3r 20 in Buckworth has by the execution of the works been permanently benefited to an extent beyond the above sum of £691 4s 5d. Now, the Inclosure Commissioners order that the above sum of £691 4s 5d, part of the sum of £11,604 3s 1d, ought to be absolutely charged upon the inheritance of the 156a 3r 2p in the parish of Buckworth. (Attached are 3 schedules of the lands affected and the costs of the work, etc).
