TitleStatement of Case Upton v Buckworth
DescriptionThe Case concerns the brook which separates the two parishes. Buckworth tenants have always cleaned the brook and kept out Upton cows etc. Upton tenants have done nothing. There was an unwritten agreement between them which the Upton tenants broke 2 years age, since when no one has cared for the brook. Now an Upton cow has got through the brook, because it was not cleaned, to the Buckworth side, where the defendant has impounded it. The cow's owner is the plaintiff.
