Description(1) The Hon. Albermarle Bertie, Swinstead, Lincs., Esq. Matthew Boucherett, Willingham, Lincs, Esq. (2) Charles Bertie, Uffington, Lincs, Esq., eldest son and heir of Charles, late of Uffington, Esq., decd, by Mary, his late wife - dau. of John Norborne, also decd. (3) Kempe Brydges, St. Clement Danes, Middx., woollen draper. (4) William Dillingham, Red Lyon St., Holborn, apothecary. (5) George Noble, London, merchant. Recites: (i) Bargain and Sale of 18 Sep. 1728 from Chas. Bertie, the father and (2) to Thos. Vawdrey and Wm. Taylor, of Hunts Closes in Molesworth (180a), messuage there, and all their messuages and lands with apps. in Molesworth, formerly the inheritance of Isabell, and of Mary Norborne, for Vawdrey and Taylor to suffer two Common Recoveries re. lands in Lincs and Hunts wherein (2) was to be vouched and vouch over Chas. Bertie, the father. (ii) Said Recoveries being suffered. (iii) Indenture of 10 Dec. 1728 between Chas. Bertie, the father, (2) and (3), reciting aforesaid lands being entailed and the Berties suffering Recovery to bar the entail. Agreed that those seised of the land by the said Recovery should be seised to the use of (3), then to such uses as the Berties appoint, and for £1,500 from (3) to the Berties they demised to (3) Hunts Closes etc. for 1,000 years. (iv) Indenture of 17 Dec. 1728 declaring that (1) the recoverors and other persons seised by the same recoveries should be seised to the several uses and trusts therein mentioned. Hunts Closes to (1) in trust to sell, and discharge the mortgage between the Berties and (3) of Hunts Closes and pay the surplus if any to the Berties. (v) Death of Chas. Bertie, the elder, with mortgage money of £1,545 still owing to (3). (vi) (4) agreed with (2) and (1) for absolute purchase of Hunts Closes for £1,541, to be paid to (3), and (2) has agreed to pay to (3) the further sum of £4. Now for £1,541 from (4) to (3), with consent of (2) and (1), and for £4 from (2) to (3), and 5/- from (5) to (3), (3), at nomination of (4), assigns to (5) Hunts Closes etc. in Molesworth for residue of Term, in trust for (4). And for 5/- apiece to (1) and (2) from (4), (1), with consent of (2) and (2), to (4), in possession by lease of yesterday, Hunts Closes etc. with all apps., with true copies of all relevant deeds. Usual conditions. (1) and (2) to perform deeds of further assurance within the next 10 years.
