TitleDeed Poll to indemnify estates with £400 per year from the mortgages affecting them and other estates and to declare the uses of a Fine
Description(Marked: F) Recites: 1) Settlement of 1st-2nd June, 1791 and its 5 recitals (H 2/58) 2) Deed to lead the uses of a Fine of 1st July, 1791 (Hinch 2/59) 3) Fine levied at Trinity Term, 1791 (Hinch 2/60-61). 4) The Earl and Countess of Sandwich are now old and are unlikely to have any more children. 5) Between the Settlements of 1740 and 1791 the lands comprized in the 1791 Settlement were, with others, mortgaged by the 4th Earl of Sandwich at different times and to different persons for securing several sums amounting to a total sum of £49,900. Now the 4th Earl and his son, Lord Viscount Hinchingbrooke, appoint that the fine levied (recital 3) shall operate to the uses following:- i) To strengthen and confirm the life estate by the Settlement of 1791 limited to Dorothy Countess of Sandwich. ii) To subject and charge all the lands etc. comprized in the fine with the mortgage debts and interest in recital 5 and subject thereto to the uses expressed in a Lease and Release of 2nd-3rd August, 1790, made between i) the 4th Earl of Sandwich ii) Lord Viscount Hinchingbrook. iii) William Fellowes of Ramsey. co. Huntingdon, Esq. iv) Edward Coleman of the p. of St. James within the Liberty of Westminster, co. Middlesex, Esq., and Owsley Rowley. Provided always that the issue of Lord Visc. Hinchingbrook claiming under the limitations contained in the Settlement of 1791 may hold all such lands etc., comprized in the mortgages as are also comprized in the fine freed from the mortgage debts and interest; and the issue shall, out of the lands etc. comprized in the mortgages which are not also comprized in the mortgages which are not also comprized in the fine, indemnify themselves and the premises comprized in the fine against the mortgage debts and interest.
